Article 3: Applicability
- These general terms and conditions apply to every offer made by the business and to every agreement concluded between the business and the consumer, both in the physical store and through the webshop.
- For online purchases, the rules in these terms and conditions concerning distance purchases apply. For purchases in the physical store, the provisions of Article 9 apply.
- Before the distance contract is concluded, the text of these general terms and conditions is made available to the consumer. If this is not reasonably possible, the consumer is informed where these terms and conditions can be viewed or requested free of charge.
- If a provision in these terms and conditions is invalid or annulled, the remaining provisions remain fully in force.
- Situations not covered by these terms and conditions will be assessed in accordance with the spirit of these general terms and conditions.
Article 4: The offer
- The offer contains a complete and accurate description of the products offered.
- Images and specifications provide a true representation, but may differ slightly in colour and detail.
- Every offer contains clear information about the price, shipping costs, payment, delivery time and right of withdrawal.
- Obvious errors or mistakes in the offer are not binding on the business.
Article 5: The agreement
- The agreement is concluded when the consumer accepts the offer and meets the stated conditions.
- If the agreement is concluded electronically, the business will promptly confirm receipt of the order by email.
- The business takes appropriate technical and organisational measures to secure electronic data transfer.
- The business may refuse an order if there are valid reasons to believe that the consumer will not meet their payment obligations.
- With every delivery, the consumer receives information about:
- the visiting address for complaints,
- the right of withdrawal and the withdrawal function,
- warranty and service conditions.
Article 6: Right of withdrawal (online purchases)
- The consumer has the right to withdraw from an order placed through the webshop within 30 days of receipt without giving a reason. This is longer than the statutory 14 days.
- The withdrawal period starts on the day after the consumer receives the product. If an order consists of several products delivered separately, the withdrawal period starts on the day after the consumer receives the last product.
- During the withdrawal period, the consumer must handle the product and packaging with care. The consumer may only unpack and use the product to the extent necessary to establish its nature, characteristics and operation, as they would in a store.
- The consumer can withdraw in one of the following ways:
- online through the withdrawal function "Withdraw from the agreement here": bymetz.nl/pages/eu-herroepingsformulier (also accessible through the link at the bottom of every page of the website);
- by email to info@bymetz.nl, for example using the model form in the appendix;
- through the returns portal: https://bymetztassenenkoffers.shipping-portal.com/rp/.
- If the consumer uses the withdrawal function, ByMetz will promptly send an email confirming receipt of the withdrawal, including its contents and the date and time of submission.
- After withdrawal, the consumer has 14 days to return the products.
- Where possible, the consumer must return the product in its original condition and packaging, with all labels, tags and accessories.
- The consumer is only liable for any loss in value of the product resulting from handling that goes beyond what is permitted under paragraph 3. ByMetz may deduct the actual loss in value from the refund.
Article 7: Returns and costs in case of withdrawal
- Returns can easily be arranged through the returns portal: https://bymetztassenenkoffers.shipping-portal.com/rp/. The consumer enters the order number and postcode, receives a DPD return label and drops off the parcel at a DPD service point. The returns portal is available in the countries listed in the returns policy.
- The cost of the return label depends on the country from which the consumer returns the product and is listed in the returns policy. It will be deducted from the refund.
- If the consumer returns the product outside the returns portal, or from a country without a returns portal, the consumer pays the return costs. Return address:
ByMetz
Winkelcentrum Woensel 59
5625 AD Eindhoven
Netherlands - If an order is delivered to a service point, is not collected and is therefore returned, the return costs and €9,95 administration fee will be deducted from the refund.
- ByMetz will refund all payments made by the consumer, including the standard shipping costs for a fully returned order, within 14 days of the withdrawal, using the original payment method. ByMetz may wait with the refund until the product has been received or until the consumer proves that it has been returned, whichever occurs first. If the consumer chose a more expensive shipping method than the standard option when placing the order, ByMetz will not refund the additional costs.
- The consumer bears the risk of the return shipment. ByMetz recommends keeping the proof of shipment or tracking code.
- It is also possible to return or exchange an online order free of charge in the ByMetz store during opening hours. This can also be indicated in advance through the returns portal.
Article 8: Exclusion of the right of withdrawal
The right of withdrawal does not apply to products that:
- are manufactured according to the consumer's specifications;
- are clearly personal in nature, such as a product with a name or text chosen by the consumer;
- cannot be returned for reasons of health protection or hygiene and whose seal has been broken after delivery;
- by their nature have become inseparably mixed with other products after delivery.
Article 9: In-store purchases
- There is no statutory right of withdrawal for purchases made in the physical store. ByMetz voluntarily offers the following arrangement.
- Money back: for purchases without a discount, the customer can receive a refund within 7 days, provided that the item is unused, undamaged and has its original labels.
- Exchange: purchases made in the store can be exchanged within 30 days, including discounted items.
- Discounted items cannot be refunded. Statutory rights in case of a defect (Article 11) always remain applicable.
Article 10: The price
- All prices include VAT and are subject to printing and typographical errors.
- Obvious pricing errors are not binding on the business.
- Price increases after the agreement has been concluded are only permitted if they result from statutory provisions.
Article 11: Conformity and warranty
- The business guarantees that the products comply with the agreement and with what the consumer may reasonably expect when using them normally (the statutory warranty).
- The consumer must report a defect or incorrectly delivered product within a reasonable period after discovering it, via info@bymetz.nl. A report made within two months of discovery is always timely.
- The statutory warranty always applies. A manufacturer's warranty or ByMetz warranty is additional and does not limit the consumer's statutory rights.
- Damage caused by incorrect use, normal wear and tear or careless handling is not covered by the warranty.
Article 12: Delivery and performance
- Delivery takes place to the address provided by the consumer.
- Orders are delivered as soon as possible and no later than within 30 days, unless otherwise agreed.
- If delivery is delayed, the consumer will be informed in good time and may cancel the agreement free of charge.
- The risk of damage and loss passes to the consumer when the product has been delivered to them.
Article 13: Payment
- Payment is made using the payment methods offered in the webshop.
- For purchases in the store, immediate payment is required at the time of purchase.
- In the event of non-payment, the business is entitled to charge statutory interest and collection costs after first giving the consumer a written payment period of 14 days.
Article 14: Contact and communication
- All communication about orders, questions, warranties and repairs takes place by email via info@bymetz.nl. ByMetz sends confirmations, delivery information and any questions about an order to the email address provided by the consumer.
- How ByMetz handles personal data is explained in the privacy policy.
Article 15: Complaints procedure
- Complaints can be submitted via info@bymetz.nl or in writing to the store address.
- ByMetz will respond to a complaint within 14 days. If a complaint requires more time, ByMetz will inform the consumer within 14 days when they can expect a substantive response.
- If the complaint cannot be resolved by mutual agreement, the consumer can submit it to Valued Shops (www.valuedshops.com), which provides free mediation. If this does not lead to a solution, the consumer can submit the dispute to the dispute committee of Stichting DigiDispuut (www.digidispuut.nl), which issues a binding decision.
- If the consumer lives in another country of the European Union, they can also contact the European Consumer Centre in their country (www.eccnet.eu).
- The consumer may always submit a dispute to the competent court.
Article 16: Applicable law
- Dutch law applies to agreements between ByMetz and the consumer.
- If the consumer lives in another country, they always retain the protection provided by the mandatory rules of the country in which they live.
- The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Article 17: Additional or deviating provisions
Additional provisions or provisions deviating from these terms and conditions may not disadvantage the consumer and must be recorded in writing.
